Definition

1st Degree Assault (Felony, Max. 20 years prison / max. $30,000.00 fine)
2nd Degree Assault (Felony, Max. 7 years prison / max. $14,000.00 ) – with increased prison and/or fines if bodily injury is involved
3rd Degree Assault (Felony, Max. 5 years prison / max. $10,000.00 fine)
4th Degree Assault (Gross Misdemeanor, Max 1 year in jail / max. $3,000.00) – with increased prison and/or fines if bodily injury is involved
5th Degree Assault (Misdemeanor, Max. 90 days in jail / max. $1,000.00 fine for first time offenders) – with increased charges, jail and/or fines for repeat offenders
